What is the Energy Performance Certificate?
Royal Decree 235/2013 of April 5th approves the basic procedure for the certification of the energy performance of buildings (BOE April 13th, 2013).
'When buildings or building units are constructed, sold, or rented, the energy performance certificate or a copy of it must be shown to the prospective buyer or tenant and delivered to them, as established in the basic procedure.\'
'The label must be included in all offers, promotions, and advertisements directed at the sale or rental of the building or unit.\'

Serious Offenses
Selling or renting a property without providing the buyer or tenant with a valid, registered, and current energy performance certificate. Fine: €601 to €1,000.
Minor Offenses
Advertising the sale or rental of buildings or units that require an energy performance certificate without mentioning the energy rating. Fine: €300 to €600.
The individuals or legal entities who commit these offenses—even through mere negligence—will be held responsible.
